Residential Foreclosure Timeline

Two to three months after falling behind on your mortgage, you will receive an acceleration notice of foreclosure from the lender telling you to bring your payments up to date. If you cannot bring the mortgage current, you will get a letter from the lender's foreclosure attorney. You will have 30 days to dispute the validity of the debt. The lender's attorney can schedule the sheriff's sale after you miss any mortgage payments. You will be served with notice of the sale four weeks prior to the sale. You are allowed to make the mortgage current until the date of the sale. You may also attempt to refinance or sell the home prior to the sheriff's sale.

The sheriff's sale takes place at auction, not at your home. After the sale, you have six months to redeem or pay off the entire mortgage, including the fees accrued during foreclosure. You may stay in the home during this time.

Filing bankruptcy interrupts the sheriff's sale process if you file before the sale occurs. This can be a complex issue, however, and you must have an attorney who is experienced with bankruptcy and foreclosure defense to ensure the process goes smoothly.

Filing after the sheriff's sale is not as effective. It may be possible to extend the grace period by 60 days in some cases. Speak with one of our attorneys to learn more about how this may apply to you.
